Alabama Senate passes near total ban on abortion”

Legislation to restrict abortion rights has been introduced in 16 states this year, four of whose governors have signed bills banning abortion if an embryonic heartbeat can be detected.

Alabama's state Senate passed a bill on Tuesday to outlaw almost all abortions, creating exceptions only to protect the mother's health, as part of a multistate effort to have the U.S. Supreme Court reconsider a woman's constitutional right to an abortion.

It's the latest in an onslaught of state-level anti-abortion measures that activists hope will be taken up by the Supreme Court and potentially overturn Roe v. Wade, the landmark 1973 decision that protects a woman's right to the procedure. But other Senate leaders have insisted that there be exceptions for rape and incest.

The bills would prohibit physicians from performing a dilation and evacuation abortion except to save a woman's life. Stiller calls the legislation political and an "affront to women's rights".

Senators rejected an attempt to add an exception for rape and incest. "You don't have to do anything for that child, yet you want to make that decision for that woman", Democratic Sen.

Ivey has not publically said whether she will sign the bill if it's approved by lawmakers.

Democratic Gov. Gretchen Whitmer is expected to veto the legislation, which can not go to her desk until next week at the earliest.

Alabama already has a case in the federal courts over a restrictive abortion law passed in 2016.

Courts have blocked bans on the procedure in other states, and the issue ultimately may be decided by the U.S. Supreme Court. That lawsuit came after the state was forced to pay the ACLU and Planned Parenthood $1.7 million in 2016 after a law requiring abortion providers to have hospital admitting privileges was struck down by federal courts.

"They know it's unconstitutional", Figures said of the new bill.

The legislation will take effect six months after Governor Ivey gives the bill her signature. The House-passed bill does allow abortions in cases in which the mother's life is in danger. Figures said the state - which routinely flirts with budget shortfalls - doesn't have the money to spend.

Those protesting the bill said Alabama might be antiabortion but is not pro-life because it fails to support children once they are born, said Susan Pace Hamill, a law professor at the University of Alabama.

"The antiabortion carnival show now going on in the legislature is hypocritical grandstanding", Hamill said. "We want abortions to be safe, and we want them to be few, but it should be legal, because there will be abortions", Democratic Senator Linda Coleman-Madison told The New York Times.
