Carter was found guilty in 2017 and sentenced to 15 months in a Massachusetts jail for her part in the death of her boyfriend, 18-year-old Conrad Roy III, who killed himself in his auto in Fairhaven, Massachusetts in 2014.

Carter's lawyers say that's not enough evidence to prove Carter did that.

She was sentenced to serve 15 months in prison. After his death, it was revealed through text message history that Carter, then 17, encouraged him to go through with the act.

Her attorneys argued in Monday's filing that her freedom of speech may have been violated and should be protected under the constitution. Roy took his own life in July 2014 in his truck, succumbing to carbon monoxide poisoning. "Ms. Carter's conviction should not stand".

Her lawyers argued Carter's sentence is a conflict of other state Supreme Court rulings on similar cases as well as a due process violation for how the court interpreted the common law definition of involuntary manslaughter. In the doc, Carter's lawyer, Joseph Cataldo argues "there's no law that criminalizes encouragement of suicide in MA and now the district attorney's office says even though our legislature has not criminalized that behavior with the law, we're going to prosecute her with a homicide".

Michelle Carter's attorneys told the high court in a petition filed Monday that her conviction, based on her "words alone", violated her First Amendment right to free speech.
