United Kingdom court rules Johnson's suspension of Parliament unlawful

United Kingdom court rules Johnson's suspension of Parliament unlawful”

The judges said the suspension was "null and of no effect", but referred the matter to Britain's Supreme Court for resolution.

If Boris Johnson is found to have deceived the Queen he should quit, a former Tory MP has said.

After three years of Brexit crisis, British politics is in turmoil, with the prime minister blocked by parliament and an election or even a second referendum on the cards.

The ruling comes a day after the prorogation took place in the early hours of Tuesday, with Parliament now suspended for five weeks.

"If the UK Supreme Court rules in a different manner from the Scottish top court then that will have big repercussions for the [UK] union", he said.

Last week a court in Edinburgh rejected the initial challenge, but this was overturned on Wednesday following an appeal.

"We are calling for parliament to be recalled immediately", Scottish National Party lawmaker Joanna Cherry told Sky News after the verdict by Scotland's Inner Court of Session on Wednesday.

Cherry labelled the prorogation of parliament "a plot to prevent us representing our constituents views" and scrutinizing cabinet ministers over a back-door no-deal Brexit.

One of the judges, Philip Brodie, said it appeared the suspension was intended "to allow the executive to pursue a policy of a no-deal Brexit without further parliamentary interference".

"The only inference that could be drawn was that the United Kingdom government and the prime minister wished to restrict Parliament".

A British government spokesman said: "We are disappointed by today's decision, and will appeal to the UK Supreme Court".

Opposition politicians urged the government to scrap the suspension and recall lawmakers to Parliament.

In a statement, the government said it "needs to bring forward a strong domestic legislative agenda". The current litigation relating to the legality of the advice to the sovereign to prorogue Parliament is evidence of the wisdom of Powell's dictum.

Lord Doherty said Mr Johnson had not broken the law by proroguing Parliament, and that it was for MPs and the electorate to judge the prime minister's actions rather than the courts.

In a speech that is at odds with the stance of Labour's leader Jeremy Corbyn, Watson will say there is "no such thing as a good Brexit deal" and Labour must campaign unequivocally to remain, the BBC said.

"Mr Johnson doesn't have a majority, the Speaker is very concerned about the circumstances of the prorogation, his concerns have been vindicated by this ruling and therefore Parliament should return and we should be able to get on with our jobs representing our constituents".

In a tweet, Robert Buckland QC MP said: "Our judges are renowned around the world for their excellence and impartiality, and I have total confidence in their independence in every case".

The court later agreed to release the documents to the media.

In a separate case brought by anti-Brexit campaigner Gina Miller, the High Court in London also ruled last week that Mr Johnson had acted lawfully. The implications of this decision made by the Scottish courts should not be underestimated.
