McMonagle sought a mistrial, arguing Valliere, under questioning by Feden, made references to Cosby when she was supposed to testify only in general terms about victim behavior.

Constand did not report the allegations to police until a year later, on January 13, 2005, after returning to her native Canada.

She also said that reporting the incident to authorities was not necessarily a person's first response.

On Tuesday and Wednesday (June 6-7), jurors heard compelling testimony from the woman who has accused Cosby of sexually assaulting her, Andrea Constand.

Alternative to a mistrial declaration, McMonagle asked that the judge to strike the testimony or issue a cautionary instruction to the jury.

Judge Steven T. O'Neill torpedoed the request. Pacing the floor, the lawyer showed the courtroom a Facebook post from Valliere's company linking to a Washington Post article about the Cosby case during the pretrial period. "Victims want to forget about it and pretend it didn't happen", Valliere said.

His deposition also showed he anxious that his career could take a financial hit if Constand's allegations became public.

"This is your argument and I understand your argument. However, it is this court's opinion that the testimony so far is not violating the statute".

The kinky comic's testimony was read by a detective to a suburban Philadelphia jury Friday, the fifth day of his sex assault trial.

Spokesman Andrew Wyatt told reporters on Friday that Cosby's team was still evaluating whether to have him take the witness stand.

Cosby, who claimed the sexual contact with Constand was consensual, testified in the deposition he began touching Constand and that Constand did not stop him. He faces charges of aggravated indecent assault. In it, Cosby admitted to investigators that he offered to pay for Constand's education, and that he did so out of fear of reprisal, that the story would ultimately go public and ruin him. Depositions in the civil case were later utilized as part of the criminal case built against the comedian and actor. Cosby, who turns 80 in July, previously publicly said he won't testify.

In the deposition, he recounted a telephone conversation he had with Ms Constand's mother. She added the less survivors knows the perpetrator, the more likely they are to resist.

The release of the sensational testimony spurred Pennsylvania prosecutors to reopen their investigation and arrest Cosby a decade after the district attorney who originally investigated Constand's complaint decided the case was too weak to bring charges. In fact, many victims even try to rebuild a relationship with the abuser, particularly if he was a mentor or father figure, which is exactly how Cosby described his relationship to Constand.

As TMZ reports, it's possible that the Bill Cosby defense team dodged a bullet when the court denied their motion to introduce evidence regarding Ms. Constand's sexuality. He says the sexual encounter with Andrea Constand was consensual. He said he later told Constand's mother by phone that he would look up the name of the pills and inform her but never did. In a potential shift in strategy, Cosby's team has now opened the door to putting the longtime comedian on the stand to defend himself - something they had not meant to do at the trial's start.

He said: "I apologized but my apology was, 'My God, I'm in trouble with these people because this is a dirty old man with a young girl.' And the mother seizes on this...."
