Lawyers say deputy, spouse unfairly singled out”

Hernandez was hospitalized and died on May 31. Local medical examiners ruled that he died from strangulation and chest compressions.

The fight originated when Terry Thompson pulled up to the restaurant and says he witnessed Hernandez urinating in public.

Lawyers for the couple said Hernandez was drunk and initiated the fight and they were just trying to subdue the man. Protesters who gathered outside court on Tuesday have accused the couple of excessive force, adding that racial bias against a Hispanic-American was a factor.

A grand indicted the couple last Thursday.

The Thompsons are out of jail after each of them posted $100,000 bonds.

Chauna Thompson, 45, and her husband, Terry Thompson, 41, appeared in a downtown Houston courtroom Tuesday where a judge ruled they will have to take drug tests and can not have access to firearms as they wait to go to trial. The couple will be given random urine tests and will not be allowed access to guns, even with Chauna's status as a deputy.

The Hernandez family is seeking at least $1 million in damages from the Thompsons in the wrongful death civil suit, a lawyer for the family said.

At one point, the protesters surrounded the auto the couple entered outside the courthouse and temporarily blocked it from driving off. One man could be heard yelling, "Anyone else would be held without bail".

The family of John Hernandez filed a civil lawsuit against Terry and Chauna Thompson on Monday.

Dozens of protesters chased after a Texas sheriff's deputy and her husband after the couple made their first court appearance on murder charges in the death of a man they restrained during a late-night confrontation.

The Thompsons each face a murder charge in the death of 24-year-old John Hernandez.

Harris County Sheriff Ed Gonzalez said Friday that Chauna Thompson was suspended without pay following her indictment.

After the brief hearing, their attorneys said the Thompsons are being singled out because Chauna Thompson works in law enforcement.

"That's the objective of launching an internal investigation, just to make sure we are being thorough and to protect the public's trust", Gonzalez said.

A news conference about the lawsuit is scheduled for 10:30 a.m. Witnesses have said Hernandez was intoxicated when he arrived at the restaurant with his family about 11 p.m.

"They treated. John Hernandez as the criminal", he said. Attorneys said that shows premeditation.

Terry Thompson had been at the restaurant with his teenage daughter and some of her friends before the confrontation, Cagle said.

"His intention was defending himself and others from Mr. Hernandez's initial aggression", said Scot Courtney, the attorney for Terry Thompson.

But attorneys for the Thompsons contend the deputy and her husband have been treated unfairly in the case.

The march was the culmination of a week of unrest after cell phone video of the incident was released, showing Terry Thompson straddling Hernandez and holding him in a choke hold as he struggled to breathe.
