Confirmed: Trump Trashing Rules to Protect Students from Predatory Colleges”

In addition, Politico has reported what many in the higher education world have been hearing: that the Trump administration "has been eyeing further delays.as it considers opening new negotiated-rulemaking sessions to rewrite" the borrower defense rule as well as another Obama rule, called gainful employment, aimed at penalizing career training programs that consistently leave students with overwhelming debt.

Several lawmakers and observers saw the department's withdrawal of the borrower-defense rule as unfairly tipping the scales in favor of for-profit colleges. An executive from predatory Bridgepoint Education, Robert Eitel, now works at the Department of Education.

Today, U.S. Secretary of Education Betsy DeVos announced the Department's intention to establish rulemaking committees on Borrower Defense to Repayment (BDR) and Gainful Employment (GE) regulations. The rule would create standards and procedures to implement a long-standing law cancelling the federal loans of students who are defrauded by their schools.

"We need a Department of Education that will vigorously defend protections for vulnerable students, not enable the continued abuse and fraud", Healey said in a statement.

"I think discrimination in any form is wrong and I have said before and I'll say again, the department is committed to ensuring that every child has a safe and nurturing environment", DeVos said during a question-and-answer session after her address to the National Alliance for Public Charter Schools.

Due to pending litigation the Education Department said it's delaying the borrower defense to repayment rule, which was set to take effect on July 1.

"Nearly 16,000 borrower-defense claims are now being processed by the department, and, as I have said all along, promises made to students under the current rule will be promises kept", said Ms. DeVos. The Department of Education will continue to process applications under the current rule until a new one is enacted, she said.

The Institute for College Access and Success, a nonprofit organization focused on making higher education more available and affordable, said the changes would make it easier for disreputable schools "to defraud students and evade accountability" and simultaneously "make it harder for defrauded students to get their loans discharged". The chain had been accused of misleading students about the success of its graduates and was at risk of losing its academic accreditation.
