Prosecutor opposes media efforts to obtain names of Cosby trial jurors

Prosecutor opposes media efforts to obtain names of Cosby trial jurors”

Cosby's career and good-guy image were already in tatters by the time his chief accuser took the witness stand, and the prosecution's decision to pursue a second trial keeps him in legal limbo.

Prosecutors are fighting to keep the jurors' identities a secret, arguing in court documents Monday that releasing them would result in a "publicity onslaught" and make picking a jury for the second trial more hard. The names of the jurors have not been released. The 2004 encounter at Cosby's suburban Philadelphia estate was the only one to result in criminal charges.

It wasn't immediately known how many jurors wanted to convict and how many wanted to acquit.

An alternate juror in the Bill Cosby sexual assault trial told a Pittsburgh radio station he probably would have voted to convict the former comedian and TV star.

One of Bill Cosby's accuser's reacts at the Montgomery County Courthouse after a mistrial the Bill Cosby sexual assault case in Norristown, Pa., Saturday, June 17, 2017. The judge declined to do so while the trial was going on, but indicated he would consider releasing the names after the trial. He plans to retry the case within four months.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.

Mike McCloskey, one of six alternate jurors chosen for the almost two-week trial, discussed his experience in an interview with Pittsburgh radio station WDVE. McCloskey said he was "ridiculously sick" over the jury's inability to reach a verdict. The prosecution began with the 79-year-old entertainer's arrest on December 30, 2015. In that call, Cosby apologized to Constand's mother, Gianna, and described in detail the sexual acts that occurred the night Constand claims the entertainer drugged and attacked her.

The jurors for the first trial were already hard to find and chosen from a pool in Pittsburgh rather than Philadelphia where the alleged sexual assault took place and the trial was held.

"I thought there would be a lot of chatter on the bus ride home", said McCloskey.

The jury deadlocked on the sixth day of deliberations, after rehearing key testimony and asking more than a dozen questions of the court, including the definition of "reasonable doubt".

The names of the jurors who failed to reach a verdict in Bill Cosby's sexual assault trial have not been made public, but the judge could revisit the issue as early as Monday.

News outlets will ask Judge Steven O'Neill at a hearing Tuesday afternoon to release the jurors' names.

Judge O'Neill has ordered the jurors to not speak to the media on why they could not reach a decision after 52 hours of deliberation and a week of testimony. Following a series of complaints against him, he had to face three felony charges of second-degree aggravated indecent assault.
