"This video that we released today is really a textbook example of excessive force by the police".

"It turns out the agitated motorist Anthony encountered before being assaulted by Agent Joswiak was an off-duty police officer who called Joswiak to go after Anthony for tailgating him". "What I can say is while I believe there are definitely a number of honorable police officers in the community who are highly respected, we are seeing increasing, systemic problems of excessive force in the Worthington Police Department, Nobles County Sheriff's Office, and Buffalo Ridge Drug Task Force that we don't believe should ever be allowed or tolerated in a civilized society".

"Agent Joswiak claims Anthony refused his order to leave his auto, but the video contradicts this assertion", the ACLU said in a statement. "I immediately pulled over for the Worthington squad auto and before I knew what was happening I was beat and ripped from my vehicle".

"The video, viewed in a vacuum, shows only a short segment of the incident that is the basis of the criminal charges", said the statement from the Buffalo Ridge drug task force, the Worthington police department and the Nobles County attorney's office.

Further details on the case weren't readily available Thursday.

Promvongsa kept following the off-duty officer, who proceeded to park his vehicle where another off-duty officer was located, the report said.

The incident began when an off-duty officer called in a report that Promvongsa was driving recklessly.

According to the criminal complaint, Worthington Police Officer Colby Palmersheim was driving his squad vehicle when Promvongsa pulled up behind him "at a high rate of speed".

The Worthington Police Department was surprised by this video Thursday and did not immediately respond for comment after it was shared with the department. The events shown in the video followed.

The video shows Joswiak kneeing Promvongsa three times, as well as punching him and elbowing him. Worthington Police Sgt. Tim Gaul came to help, and the two lawmen stopped Promvongsa. In both incidents he allegedly dislocated the plaintiffs' shoulder, one of whom was eight-months pregnant, according to court papers.

According to the criminal complaint, he was charged with possessing marijuana, assault with a risky weapon, fleeing police in a vehicle and driving after his license was revoked.

Promvongsa has pleaded not guilty to the charges and faces up to 17 years in prison if convicted. The ACLU of Minnesota says in the video that the second officer intentionally turned off the audio (remotely), which could indicate a some sort of a cover-up attempt. "It's not just an arrest, but it's a beating of a young man", said John Gordon, Interim Legal Director for the ACLU of Minnesota. "No matter what happened before the dashcam video began rolling, Anthony did not deserve to be abused by police that way".
