Three New Zealanders - Jamie Wellington, 31, and Mark Parker and Jared Gane, both 27 - were among the people killed in the attack on the popular nightspot on October 12, 2002.

Hambali has been detained by the Central Intelligence Agency since he was arrested in 2003 and held at Guantanamo since 2006, but has never previously been charged with an offense.

The Oct. 12, 2002, Bali resort island attacks, which occurred near the USA consulate, killed 202 people, including 88 Australians and seven Americans.

The review commission was established in 2013 for the prisoners held at the Guantanamo, who have been there for years waiting for their release or to face trials. Another suicide bomber detonated a massive bomb loaded in a vehicle parked on the street in front of two clubs.

Guantanamo Bay prisoner Riduan Isamuddin was accused in a US war court on Friday of orchestrating the 2002 Bali bombings and a 2003 attack on a hotel in Jakarta that killed 12 people. The Aug. 5, 2003, auto bomb in front of the hotel in Jakarta killed 12 people and wounded 150. Three Australians were among 12 people killed in that vehicle bombing.

In 2016, Guantanamo Bay's Periodic Review Board determined that Hambali's detention was necessary "to protect against a continuing significant threat to the security of the United States", adding that Hambali "remains steadfast in his support for extremist causes and his hatred for the US".

Prosecutors believe the Marriott was targeted with the expectation there would be a large American presence there.

Hambali was captured in Bangkok in 2003 and has been held in Guantanamo Bay without charge since 2006.

"I hope that should this prosecution succeed, it will bring closure to those devastated by the loss of loved ones, family and friends", Julie Bishop, Australia's foreign minister, said.

'It has been a scar on the hearts of all Australians since these attacks occurred in 2002'.

He is also believed to have an association with al-Qaeda, the Pentagon said before the hearing.

For Australia, which suffered the most casualties, the Bali bombs were the worst peacetime attack on its citizens.

"This is an internal process in the USA and is aimed to provide transparency and legal certainty to Hambali", Nasir said in the Sydney Morning Herald.

"The charge sheet says, as you know, he was the overseer of the Bali bombing and of another bombing in 2003 in Jakarta, Indonesia in American hotel the Marriot".

"Those responsible for the murder of 202 people including 88 Australians should be prosecuted, should receive the severest of punishment and should never be freed", she said.
