Supreme Court to Hear Case Gay Wedding and Bakery Case”

The Supreme Court brief filed by Jack Phillips claims that he has no problem making other types of cakes for his gay and lesbian clients, but he was bound by his religious beliefs and therefore couldn't serve a wedding cake to these same clients.

The court clearly wrestled with the cake shop case, having relisted it for every weekly conference since January before finally deciding to take it up during the last week of the term.

Craig, Mullins and the state of Colorado argued that Masterpiece Cakeshop is a public accommodation and can not discriminate among its customers.

In the cake case, Charlie Craig and David Mullins approached Masterpiece Cakeshop to order a cake for their wedding reception.

Kasey Suffredini, acting CEO and president of strategy at Freedom for All Americans, said in a statement the Supreme Court should remember the same-sex couple seeking a wedding cake "were unfairly denied service at a business due to their sexual orientation".

When the state's civil rights commission found in the couple's favor, Phillips appealed and the case made its way toward the Supreme Court. "He simply believes that only marriage between a man and a woman should be celebrated", his lawyers wrote in the petition asking the court to take the case. Phillips has contended that the law violated his rights to freedom of speech and the free exercise of religion.

In the midst of Pride Month celebrations everywhere, the Supreme Court agreed Monday morning to hear an appeal from a baker saying he has the right to deny a gay couple the services of his business.

When the cake shop lost its appeal in 2015, a staff attorney for the American Civil Liberties Union's LGBT Project emphasized in a statement that no US citizen "should be turned away from a shop or restaurant because of who they are or who they love".

The controversy arose after the proprietor of a Colorado bakery, Jack Phillips, declined to produce a wedding cake for an LGBT couple. In the 2015 Obergefell v. Hodges ruling, the justices said that same-sex marriage was a constitutionally guaranteed right in all states.

The baker from a suburb of Denver argues he did not turn away the gay couple in 2012 because they were gay, but because their marriage violated his religious belief.

"At issue is whether an American has a right to speak and live consistent with his beliefs on what marriage is - and consistent with his religious convictions", she told me. He said other bakeries would accommodate them.

This isn't about freedom of religion, it's about the freedom to discriminate.


Under most states' laws and federal law, LGBTQ people aren't explicitly protected from discrimination in the workplace, housing, and public accommodations.
