White House Plan Would Expand Deportations”

The DHS memo was first delivered to the White House in May and agency officials are reviewing comments on the document from the Office of Management and Budget, reports WaPo.

The Trump administration is considering a proposal that would grant the Department of Homeland Security expanded to power to expedite the deportation of undocumented immigrants living in the United States.

Since 2004, the agency has been authorised to bypass immigration courts only for immigrants who had been living in the country illegally for less than two weeks and were apprehended within 160km of the border.

A memo, obtained by the Post and described as a draft by a DHS spokeswoman, would allow the agency to circumvent immigrations courts for the removal of immigrants apprehended anywhere in the country and who can not prove that they've been in the US for more than 90 days.

The policy change, which is still being debated within the administration, would not require congressional approval.

An administration official told the Post that, as with much the White House has already done or suggested doing with regards to immigration policy, they think the new deportation guidelines would help deter immigrants from trying to enter the USA or overstaying their visas in the first place.

The new plan is also, of course, consistent with the Trump administration's ongoing efforts to aggressively speed up and expand the government's capacity to target, locate, and remove undocumented immigrants.

Trump has also lifted restrictions applied to millions of undocumented immigrants from deportation if they had no criminal histories or were the parents of American-citizen children.

At the beginning of 2017, more than 534,000 removal cases were pending in immigration court, according to the memo, according to The Washington Post. That includes hiring thousands more Border Patrol agents and building a massive wall between the USA and Mexico.

Technically, the DHS proposal stops far short of legal limits on expedited deportations.

That would represent a major shift from current law, which allows such expedited deportations only in cases where the undocumented immigrant has been in the USA for less than two weeks and was taken into custody less than 100 miles from the border.

Trump administration officials floated the 13-page internal memo in May. "The expansion you describe is explicitly allowed" under federal law.
