Attorneys for Edwards' family say the gunshot residue came from Oliver when he contaminated the scene, and that any implication that the teen handled a weapon is false. While Gross ran out to see where they'd been fired, Oliver writes that he went to get his Modern Carbine patrol rifle.

Oliver fired three to five times into the auto and Jordan Edwards, 15, was mortally wounded.

Lee Merritt, the lawyer for Jordan's family, slammed Oliver's suggestion that someone in the vehicle - two of Jordan's brothers and two friends - was part of a gang.

Oliver, 37, was sacked in May for violating department policies, but police officials haven't specified which ones.

He said Oliver was making "meritless and unsupported allegations". Oliver's response said he is considering asking to have his trial moved out of Dallas County.

Edwards' father has sued Oliver and Balch Springs, alleging his son was the victim of excessive force.

Oliver's response also said that he "understands that one or more of the occupants has associated with, affiliated with, participated with, and/or been a member of a gang", adding that "one or more of the occupants handle a firearm" that night. I pray that this case will not only result in Roy Oliver being held fully responsible for his actions; but that it will also force Police Departments nationwide to address the cultural and environmental factors that promote violent and lethal action against innocent civilians. He said they heard six to 10 gunshots as they were investigating the party. "Their facts have veered, and they are completely fabricated, and completely inconsistent with the investigation".

Merritt also denies that any of the occupants were gang members, as well as denies the presence of a gun in the vehicle.

"A gun in the vehicle?"

Oliver was sacked in May for violating department policies and indicted this week on a murder charge and four charges of aggravated assault with a deadly weapon by a public official related to the other four teens who were in the vehicle.

A grand jury indicted Roy Oliver, 37, one one count of first-degree murder for his role in the incident that left 15-year-old Jordan Edwards dead.

"It makes us feel hopeful", said Charmaine Edwards.

"Hopefully, it's a message to the bad officers", said Dallas County District Attorney Faith Johnson during a press conference on Monday, "And that is, if you do wrong, we will prosecute you".
