David "Jackson" Mueller sued Swift, 27, in September 2015 claiming he lost his job at Denver radio station KYGO because the music superstar falsely accused him of groping her and lifting up her skirt while backstage at a 2013 concert. Swift countersued in October 2015 for assault and battery, claiming that Mueller waited "unreasonably" long to file his action, adding that "Mueller did not merely brush his hand against Mr".

"This flawless storm of threats to Mr. Mueller's perceived status is consistent with the well-settled, academically-accepted, perceived threats to status that motivate a man to commit sexual harassment or assault", Bayard de Volo stated in a report on the case. Second, he was sent on a tour with fans instead of radio executives, threatening his radio personality status. And third, Swift appeared excited to meet his girlfriend while Mueller may have felt invisible, threatening his masculinity.

Martinez also found that any potential value of de Volo's testimony would be substantially outweighed by the risk of prejudice against Mueller. By providing "profile evidence" in this way is inherently prejudicial because the jury must accept a potentially erroneous starting point to consider the evidence.

A rep for Swift didn't immediately reply to a request for comment. He's chose to bar Lorraine Bayard de Volo's opinion that Mueller's behavior is consistent with emotional and psychological traits associated with the types of men who harass and assault women. Additionally, she has 20 years of teaching and research experience in the field of gender and violence.

According to the Denver Post, the U.S. District Judge William Martinez has allowed Swift's attorneys to question Mueller about a two-hour conversation with his boss, Robert Call he secretly recorded the day before he was sacked.

The sanction will allow attorneys to bring up the electronics during the trial, which is set to take place in August.

Judge Martinez asked if settlement was possible.
