Malami orders Magu, EFCC to submit details of 'serious cases'”

The Economic and Financial Crimes Commission (EFCC) has said that it has no existing or impending face-off with the Office of the Attorney-General of the Federation and Minister of Justice, Mallam Abubakar Malami (SAN).

He however dismissed suggestions that there was clash between Magu and Malami, noting that all the office of the AGF wanted is compliance with the EFCC (Enforcement) regulations 2010.

Top officials of the EFCC were said to have however become anxious that the directive was a veiled attempt to whittle down the power of the Magu-led EFCC as the AGF could determine what cases to proceed with or discontinue after receiving the report.

"I am directed to refer specifically to Section 10 (1) which mandates the Commission to forward to the Attorney-General, in respect of a case of complaint which is serious or complex within the context of the Regulation, the outcome of its investigation (s) with its recommendations on whether there are sufficient grounds to initiate prosecution".

The letter is said to be a follow-up to one written to the commission in July 2016, also requesting for the files of indicted former governors and senators.

The Senior Special Adviser to the President on Prosecution, Chief Okoi Obono-Obla, recently raised eyebrows when he warned the EFCC against subverting the powers of the Attorney General on prosecution of such high profile cases.

"The letter was about the case files because if the cases are not well prepared, the office of the AGF will be blamed for it".

Its spokesperson, Wilson Uwujaren, said "For the avoidance of any doubt, the EFCC wishes to categorically state that it is in compliant with all provisions of law, and has no intention to stoke misunderstanding over requests from the office of the Attorney-General and Minister of Justice". So, the office wants to carry out its oversight function.

Media reports had suggested that the "crisis of confidence" between the AGF and the anti-graft agencies, particularly the EFCC, would undermine the anti-corruption war of the current administration. Why is it that the EFCC is not cooperating when we are working for the same government?

The EFCC is yet to react to the directive. "We should not personalise our institutions".
