Kenya's top court to rule on validity of presidential election”

Kenya reaches a milestone in electoral dispute settlements with a landmark decision of the country's Supreme Court to annul the results of the presidential election held on August 8, 2017.

East Africa's biggest economy has a history of disputed elections.

Odinga had unsuccessfully challenged the results of the 2013 vote.

"The declaration [of Kenyatta's win] is invalid, null and void", said Judge David Maranga, announcing the verdict backed by four out of the six judges and drawing cheers outside the court from Odinga supporters.

The court said the August 8 election was not conducted in accordance with the constitution. However, that report found that a third of the forms lacked security features like watermarks or serial numbers, which election observers say are evidence that the forms are likely false.

In the run-up to the Supreme Court hearing, Mr. Odinga, in an interview, said it didn't matter whether the court ruled against him.

The Supreme Court will deliver judgment on the presidential election petition filed by Nasa at 11am, the Judiciary has said.

Mr. Campbell expressed concern that "neither Kenyatta nor Odinga prepared their followers for the possibility of losing", he said. But he said the decision had to be respected.

However, Mr Odinga, of the National Super Alliance (Nasa), contests the win, arguing that the poll was marred by massive irregularities and inconsistencies.

The rejected votes will play a key role in deciding whether President Kenyatta met the threshold of 50 per cent plus one vote.

IEBC Chairman Wafula Chebukati, through lawyer Kamau Karori, argued before the court that the Nasa petition was devoid of merit and the complaints made can not be used to subvert the will of Kenyans.

This time, his team focused on proving that the process for tallying and transmitting results was flawed, rather than proving how much of the vote was rigged. "It's a huge red flag that something weird is going on", he said.

Kenya's dollar bonds fell after the ruling.
