The Delhi High Court has dismissed BJP leader Subramanian Swamy's plea seeking directions to Delhi Police, CBI and the Ministry of Home Affairs to constitute a Special Investigation Team (SIT) for conducting a court-monitored probe into the death of Congress MP Shashi Tharoor's wife Sunanda Pushkar. The claims of concealing the information came in after Swamy had offered to file an affidavit with the court disclosing the reasons based on which he had filed the plea with the Court.

Through the proceedings of the case on Thursday, Swamy and the Bench entered into heated arguments with the former often attempting to emphasise on his understanding on the law and his social profile - that of a former law minister of India.

The Delhi High Court also rapped Swamy and said that it is left with distinct impression that this is perhaps a textbook example of "political interest litigation" being dressed up as PIL. This is not my first PIL. Many of them are reported judgments and I have been successful in majority.

Pushkar was found dead under mysterious circumstances in a suite of a five-star hotel in Delhi on the night of January 17, 2014. Dr. Swamy was asked whether he had any basis for alleging that the investigation was "botched" by the Delhi Police at the "behest of rich and influential". The court also termed as "disturbing feature" the fact that Swamy's PIL and few documents filed in court were put online, even before they were considered by the court.

The High Court court dismissed the petition stating it to be frivolous and warned both Swamy and his lawyer to be extra cautious while levelling wild allegations.

A division bench of Justice S Muralidhar and Justice I S Mehta said that "courts should be careful in not letting the judicial machinery being used by political personalities for their own purposes".

The bench highlighted that the plea filed by Swamy and advocate Ishkaran Singh Bhandari had said the investigation into Pushkar's death was... But the court rejected the argument saying that Swamy in his affidavit had said that he has not concealed any information.
