Girl Detained By Border Patrol After Emergency Surgery Released To Parents”

Border Patrol agents learned about Rosa Maria, who has cerebral palsy, when she was on her way to Corpus Christi to have surgery on October 24, and had to pass through a border checkpoint to get to the hospital. When Border Patrol agents discovered that she did not have legal status, they followed the ambulance to the hospital, stood guard outside her hospital room and turned her over to immigration custody after her release.

Rosa Maria Hernandez and her parents had been living in Laredo, Texas - in the US without permission - and the Border Patrol had taken her into custody as she was transported through a checkpoint on her way to a Corpus Christie hospital for surgery.

The ACLU had filed a lawsuit earlier this week seeking the child's release. The ACLU sued the government on Rosa Maria's behalf on October 31, days after she and an adult cousin were followed by Border Patrol to a children's hospital. He has vowed to build a wall along the Mexican border.

After she was release, the girl was reportedly taken to a facility in San Antonio for migrant children who come to the USA alone.

"The Trump administration has not made clear whether they will proceed with deportation proceedings against her", he said in a statement.

Leticia Gonzalez, an attorney for Rosa Maria's family, said the 10-year-old had the mental capacity of a child closer to 4 or 5 years old due to her cerebral palsy. Biery also suggested Rosa Maria could be reunited with her mother, Felipa de la Cruz, if de la Cruz was also apprehended and processed for deportation, which Biery doesn't understand why this hasn't already happened.

"I'm a mother", said Ms de la Cruz, who is also undocumented.
