Virginia's House Republicans are threatening a lawsuit to force the State Board of Elections to certify the final results from the November 7 elections that would give Republicans a 51-49 majority in the chamber.

The State Board of Elections voted 3-0 on November 20 to indefinitely delay certifying the results in both the 28th District and the 88th District. Republicans heading into the certification process have control of 51 House districts to the Democrats' 49.

"The letter sent today lays out clearly for the board its responsibilities and the legal precedent before us. We don't like the winners, we're gonna have the new election".

Two weeks after the November 7 election that brought the "iron-clad" control of Republican control of the Virginia House of Delegates to a race where one final tally could determine control of the chamber, the state board of elections has put a hold on certifying the final count.

The board certified results in two other closely-contested races - the 40th in northern Virginia where the Republican is a 106 vote victor, and Newport News' 94th where a change is more likely to happen as the Republican is just a 10-vote victor.

Seems Fredricksburg registrar Juana Pitchford "erroneously assigned" 83 voters from House District 28 to the 88th.

Wheeler warned though that the board's responsibility at this point is mainly to certify the results submitted by the local electoral boards, who run elections. The board has chose to delay certifications for both districts while Democrats file suit.

Democrats for statewide office - Ralph Northam for Governor, Justin Fairfax for Lt. Governor, and Mark Herring for Attorney General - were certified as all three won by comfortable margins. "This error, if it occurred, will not change the outcome of the race in House District 28". That could lead to one candidate or the other being declared the victor or a rerun of the election.
