Supporters seek shielding of young immigrants”

The 9th U.S. Circuit Court of Appeals will soon decide if the Trump administration was justified in its decision to end DACA. The battle over Deferred Action for Childhood Arrivals moved to the US Ninth Circuit Court of Appeals in Pasadena. The White House wants the 9th District Court to throw out a January decision by a federal judge in San Francisco to block the president's bid to end DACA. About 40 DACA supporters gathered outside the courthouse, carrying signs that said "Immigrant rights are human rights" and "Our strength stems from our roots".

The three-judge panel of the 9th US Circuit Court of Appeals seemed concerned about how the Trump administration chose to unwind the DACA program, whether the move had violated the equal protection rights of the recipients and if the court should take presidential tweets and statements in consideration as they considered the case. A Trump administration attorney argued the White House had the authority to end DACA, a program which has protected 700,000 undocumented immigrants from deportation. Trump has even said he has considered breaking up the court. It was not clear when the court would rule. Three appellate court judges heard arguments from the Department of Homeland Security and the state of California including the UC system.

Judge Jacqueline Nguyen questioned whether courts could intervene if they thought DACA was legal and disagreed with the administration's position that it was unconstitutional. Dreamers were brought to the USA illegally as kids or came with families which overstayed visas. The program allows them to legally live and work in the U.S.

Michael Mongan, the solicitor general of California said the administration hadn't shown "its homework" and it was necessary to do so before terminating the program. He also said the administration hadn't decided, in another case, whether to issue a new memo explaining the plan to cut DACA.

The 9th U.S. Circuit Court of Appeals on Tuesday will be the first federal appeals court to hear arguments about President Donald Trump's decision to phase out the Deferred Action for Childhood Arrivals program.

The ultimate fate of DACA likely rests in the hands of the U.S. Supreme Court.
