Huawei Sues U.S. Over Equipment Ban, Escalating Legal Clash”

Today, Huawei held a press conference at its Shenzhen headquarters to issue an important statement where it revealed that the company has made a decision to sue the United States government.

The privately owned firm has embarked on a public relations and legal offensive as Washington lobbies allies to abandon Huawei when building 5G networks, centering on a 2017 Chinese law requiring companies cooperate with national intelligence work.

Lifting the ban "will give the USA government the flexibility it needs to work with Huawei and solve real security issues", Guo said.

Huawei has responded with an aggressive PR campaign to counter the USA warnings, with reclusive founder Ren Zhengfei denying the claims in a series of foreign media interviews.

Huawei rotating chairman Guo Ping said in a statement: "The US Congress has repeatedly failed to produce any evidence to support its restrictions on Huawei products". We are compelled to take this legal action as a proper and last resort, ' Huawei's rotating chairman Guo Ping said. Essentially Huawei is publicly accusing the USA of not playing fair.

"[You need to] realize that companies like Huawei and ZTE are wholly subsidiaries of the Chinese Communist party and therefore we have significant concerns about the extent to which they are able to infiltrate our domestic industry here", said Republican Congressman from Wisconsin Mike Gallagher.

Chinese foreign ministry spokesman Lu Kang said he had no information on whether China's government may also seek legal action against this US law, but added Huawei's move is "totally reasonable and totally understandable".

Song Liuping, Huawei's chief legal officer, described the U.S. ban as based on "numerous false, unproven and untested propositions".

Though more broad, it's likely that the United States government ban will have a similar effect on Huawei there; with all the large carriers likely to provide services to the USA government in some shape or form, they are effectively prevented from including any Huawei equipment in their service offering.

As expected, the announcement appears to be an attempt to force the USA government to show its hand for its reasons for barring the company's technology.

Huawei is increasingly in the crosshairs of the USA government and its allies, just as it's pushing for leadership in supplying fifth-generation wireless technology. The US government "has hacked our servers and stolen our e-mails and source code", he said at the news conference. Even worse, the U.S. Government is trying to block us from the 5G markets in other countries.

Huawei's suit echoes that of the Russian cybersecurity firm Kaspersky Labs, which was similarly banned by Congress on fears it would help Moscow spy on the United States - and sought to overturn the ban with similar arguments.

"Huawei has never had the chance to cross examine its accusers ... US Congress has simply attacked as lawmaker, prosecutor and juror at the same time, contrary to the American constitution", Song said.

"The solution to cyber security will come from openness, agreed worldwide standards certification schemes and transparency".

Huawei also repeated its argument that a blockade on its gear simply disadvantages Americans.

In response to a Reuters query, Joe Kelly, vice-president of communications, said Huawei was hiring but not more than usual, to fill positions where people had been assigned overseas. President Trump signed the ban December 12, 2017.
