Maryland court reinstates Adnan Syed's murder conviction”

On Friday, Maryland's top court reinstated the murder conviction of Adnan Syed, whose case gained prominence after it was examined in the Serial podcast.

The Maryland Court of Appeals agreed with the intermediate court that the trial lawyer was ineffective for failing to contact the witness, but said Syed was not prejudiced by that failure.

The court said Syed waived his ineffective counsel claim.

Adnan Syed, who was convicted of killing ex-girlfriend Hae Min Lee in 1999, had been granted a retrial in 2016 - two years after the 12-episode focus on his case became a download hit.

The woman was a big factor in the This American Life podcast's first season because she claims she saw Syed in the Woodlawn High School library around the time that prosecutors contend that he killed Lee off-site.

The decision followed a lower court ruling to grant a new trial to Adnan Syed on charges of murdering his former girlfriend, after the podcast, produced by Chicago public radio station WBEZ, revealed evidence that he had received an ineffective defense.

Even if the alibi witness was correct about seeing Syed in the library during a 10-minute period the day of the murder, it does little more than call into question the prosecution timeline, Greene said.

'Our criminal justice system is desperately in need of reform.

A jury in the Circuit Court for Baltimore City convicted Syed of first-degree murder, robbery, kidnapping and false imprisonment on February 25, 2000.

Before the 1999 trial, the defense claims that Syed asked Gutierrez if she had reached out to Asia McClain, to which Gutierrez responded that nothing had come of it.

The docu-series has been in production since 2015, and within that span, the production team's worked with private investigators in an effort to uncover new evidence and reexamine the case against Syed.

'We think just the opposite is true.

Made famous by Serial, Syed's case is now being turned into an HBO miniseries.

Mr Brown said the case could go to a national level.

The case for a retrial centres on an alibi witness who was not called in the original trial.

"Justice was done for Hae Min Lee and her family", Frosh said.

In February 2016 when Adnan was seeking a new trial, Lee's family released this statement: 'It remains hard to see so many run to defend someone who committed a awful crime, who destroyed our family, who refuses to accept responsibility, where so few are willing to speak up for Hae'. Stetson argued the attorney had failed her client by not calling the witness - a violation of his right to effective counsel.
