Chris Ayres and R. Jack Ayres, the lawyers representing the family of alleged shooter Patrick Crusius, said his mother contacted police because she was anxious about her son owning the weapon given his age, maturity level and lack of experience handling such a firearm.

He says Crusius later waived his Miranda Rights and agreed to speak with detectives, telling them he was targeting Mexicans during his attack.

But the mother's call was "informational" and not motivated out of a concern that her son posed a threat, the lawyers said, adding the mother did not give police her name or her son's name.

Crusius is being eyed in connection to an online rant posted before the shooting that complained about the "Hispanic invasion of Texas". They then saw a man - identified as Patrick Crusius, the 21-year-old charged with capital murder in the case - get out of the vehicle with his hands in the air, the affidavit said. A public safety officer allegedly told her that he was legally allowed to purchase the weapon and did not pursue any additional information about her concerns; attorneys said she did not provide her name or her son's name.

The attack at the Walmart store in El Paso came hours before another mass shooting in Dayton, Ohio, in which nine people were killed. - The August 3 shooting left 22 people dead.

The massacre in the predominantly Hispanic city of El Paso is being investigated as a hate crime and act of domestic terrorism, authorities said. It was unclear where Crusius was heading, though Allen has suggested that he did not know the area well and got lost in a neighborhood upon arriving.

An attorney for Crusius did not immediately respond to a request for comment about the affidavit. "He was raised in a family that taught love, kindness, respect, and tolerance - rejecting all forms of racism, prejudice, hatred, and violence".

Many El Paso residents, protesters and Democrats have blasted Trump over his incendiary words, blaming Trump for inflaming political and racial tensions throughout the country.

In El Paso, 22 people were killed and 24 others injured on Saturday when a gunman opened fire at a local Walmart.
