In the past, guards at both federal and state prisons have faced criminal charges over false entries in duty logs that were discovered after something went wrong with a prisoner. But investigators have learned those checks weren't done for several hours before Epstein was found, according to one of the people familiar with the episode.

The court papers were filed by attorneys Brad Edwards and Paul Cassell on behalf of two of Epstein's accusers, who were identified only as Jane Doe 1 and Jane Doe 2.

Barket's statement about Epstein's death being "a silent act", however, contradicts another report that indicated screams were heard from Epstein's cell on the morning he was found unresponsive.

Sasse's letter marks the second time in less than a week that the senator has written to Barr about Epstein's death, having written over the weekend that "heads must roll" over Epstein's suicide. But he had been taken off that watch at the end of July and returned to the jail's special housing unit.

A prison and law enforcement official told The New York Times late Tuesday that the guards failed to check on Epstein for about three hours before his death - though it's unclear how much of that time was spent snoozing.

The manner in which Epstein killed himself has not been officially announced.

Justice Department spokeswoman Kerri Kupac added that Barr had appointed James Petrucci, the current warden of the Federal Correctional Institution in Otisville, N.Y., as acting warden at MCC, pending FBI and Office of Inspector General investigations.

Attorney General William Barr at a police conference on Monday said that he was "frankly angry to learn of the MCC's failure to adequately secure this prisoner".

The Justice Department says the warden of another facility in upstate NY has been named the acting warden at MCC.

Jose Rojas, a union leader and teacher at a federal prison in Florida, said N'Diaye should be home without pay instead of being reassigned.

"I put this on the warden", he said. "If he would have had common sense and followed policy, we wouldn't be here discussing this".

In the days since Epstein's death while awaiting charges that he sexually abused underage girls, a portrait has begun to emerge of Manhattan's federal detention center as a chronically understaffed facility that possibly made a series of missteps in handling its most high-profile inmate.

One of Epstein's guards the night he took his own life was not a regular correctional officer, one of those familiar with the case said.

At the same time, prosecutors pursued a parallel investigation into whether any associates of the wealthy financier will face charges for assisting him in what authorities say was his rampant sexual abuse of teenage girls.
