Prosecutors indicted Martins, 39, and Hall, 34, on lesser felony charges of receiving a bribe and misdemeanor charges of official misconduct, and meant to proceed to trial, which was set to begin September 9.

In explaining his decision to accept the plea deal, Chun pointed to the history of the case, and stated his belief that he did not believe a jury would have convicted the former officers of the felony bribe receiving charges.

"Given that there are criminal activities on both sides, however, there is one critical difference here - both the defendants before me are police officers and police officers are sworn to uphold a higher standard of ethical code, behavior or higher standard, period, than other people engaged in criminal activity".

Two former NY detectives have walked free after admitting to having sex with a handcuffed 18-year-old woman after arresting her. They were originally arraigned on 50 rape charges and faced 25 years in prison.

The cops wound up indicted on 11 lesser charges of bribery and official misconduct.

In a new press statement, Brooklyn prosecutors say Martins and Hall pulled over an Infinity Couple driven by Chambers, then 18.

Their stars seem to favor them, as the prosecutors appealed for 1-3 years prison time for them.

"These defendants engaged in a shocking abuse of power which they finally acknowledged", Brooklyn District Attorney Eric Gonzalez said.

"We could not apply the new law retroactively, and serious credibility issues in this case precluded us from proceeding on additional charges", said Mr Gonzalez, "yet we remained committed to holding these defendants accountable".

Initially, Martins and Hall were charged with rape, sexual assault, and kidnapping. Last year, the state legislature voted to pass a law classifying a police officer having sex with someone in custody as rape in the third degree, a law that came about in large part as a result of the Brooklyn case.

Justice Chun declined to comment regarding the sentence. The officers admitted that they took turns having sex with the woman in the back of a police van as they drove her around New York City, but claimed that the sexual encounter was Chambers' idea, and that she offered to have sex with the officers if they released her without reporting the arrest.

Prosecutors said the defendants left their post without authorization and later stopped a auto driven by the 18-year-old woman, who was accompanied by two male passengers, Gonzalez said in the statement. However, a rape kit showed a positive DNA match with the ex-NYPD detectives' saliva and semen found on the woman's body after the alleged attack.

However, attorneys for the officers claimed that, rather than a forcible rape, the woman had consensual sex with the officers in exchange for being released from custody. They did not report the incident.
