Johnson & Johnson reach $117m settlement over misleading marketing”

Attorney General Curtis Hill today announced a multistate settlement involving 41 states and the District of Columbia requiring Johnson & Johnson and its subsidiary Ethicon Inc.to pay almost $116.9 million for their deceptive marketing of transvaginal surgical mesh devices.

Numerous women who had the once-popular, hammock-like devices implanted claim they caused severe pain, bleeding, infections and other complications.

Montana will receive $1,460,022 under the settlement, which the Office of Consumer Protection will use for education, investigations, and enforcement of Montana's consumer protection laws, the release said.

OH attorney general Dave Yost said the agreement orders Johnson & Johnson, as well as its subsidiary Ethicon, to pay $116.9 million to the 41 participating states and the District of Columbia.

Johnson & Johnson sold transvaginal surgical mesh devices that were surgically implanted in women to help them with bladder issues or to help them when organs shift from their original positions. In a statement, Ohio Attorney General Dave Yost said the company "didn't paint a clear picture of the device's medical risks, preventing patients from making well-informed decisions".

Ensure that product training provided to medical professionals covers the risks associated with the mesh.

Some of the products are still on the USA market, and hundreds of thousands of women have had the devices surgically implanted, according to Yost's office.

J&J officials said they had disclosed the multi-state probe to the U.S. Securities and Exchange Commission.

J&J said that the settlement doesn't include admission of any misconduct, The Associated Press reported. Those lawsuits aren't affected by the settlement.

West Virginia was one of the states not included in the lawsuit, and it filed its own legal action a month ago against Johnson & Johnson.

Disclose that risks include that revision surgeries may be necessary to treat complications, that revision surgeries may not resolve complications and that revision surgeries are also associated with a risk of adverse reactions.

J&J shares closed Thursday up $1 to $136.17, still well below their 52-week high of $148.99 late last fall.
