Michael Flynn Files to Withdraw Guilty Plea for Lying to Federal Bureau of Investigation”

After months of bickering with prosecutors about his cooperation, Michael Flynn saw his legal counsel file a notice announcing his intention to withdraw his guilty plea "because of the government's bad faith, vindictiveness and breach of the plea agreement". "He gave the prosecution his full cooperation".

The motion filed by Flynn's attorneys also points out other new developments in Flynn's case, particularly the FISA abuses uncovered last month in the Department of Justice Inspector General's report showing the abuses used by the Federal Bureau of Investigation to spy on Trump campaign aides.

In the court filing, defence lawyers said the Justice Department is attempting to "rewrite history" by withdrawing its recommendation that Mr Flynn be sentenced to probation and by suggesting he had not been forthcoming or cooperative.

She argued that Flynn upheld his end of the plea deal in being truthful, but the government did not uphold its end and tried to coerce Flynn to lie.

"The sworn statements of Mr. Flynn and his former counsel belie his new claims of innocence and his new assertions that he was pressured into pleading guilty", Sullivan wrote in his December 16 opinion.

"He endured massive, unnecessary, and frankly counterproductive demands on his time, his family, his scarce resources, and his life", they added.

"The same can not be said of the prosecution, which has acted in bad faith since the start of the" investigation "and continues unabated through this specious pursuit".

He cooperated extensively with the government over the next year.

In Tuesday's indictment, Flynn's defense requested that the sentence be postponed until February 27 to allow the government to respond to the withdrawal of their client's guilty plea and to provide Flynn with "additional information that he needs to protect the file and his constitutional protection rights in light of important developments in the past 30 days".

Flynn asked that the hearing be put off so that he could continue cooperating with prosecutors in hopes of avoiding any prison time.

In the court filing a complaint on Tuesday, Flynn's lawyers cite the "bad faith, revenge and violation of the case" for the decision to withdraw his case.

A spokeswoman for the United States attorney's office in Washington did not immediately return an email seeking comment.
