Apple loses latest battle in $503-million FaceTime case”

A U.S. appeals court denied a request by Apple that it reconsider the company's appeal against VirnetX in their patent dispute, Reuters reports. An appeals court whittled the infringing patents to just two.

In the November ruling, a three-judge panel of the court voided a jury's calculation that Apple should pay $503 million (389.6 million pounds) for infringing VirnetX patents.

Apple argued in its petition for reconsideration that the panel was wrong to preclude it from renewing its invalidity arguments, saying it wanted to raise different legal issues. Visit for more information on this news.

The patent battle has seen VirnetX seeking to disable Apple's Facetime and iMessage services, after a jury verdict that found the Apple software contained patented technology. It also sought to have the court reconsider the infringement finding that was upheld. Apple had asked the entire court to reconsider the part of the court's previous ruling, made by a three-judge panel, that remanded the case back to the district court in Texas.

The Texas judge in the case must reportedly decide whether to hold a new damages-only trial or to recalculate damages without holding one. VirnetX has said that there is no final decision to cancel those patents, so Apple's argument is premature and part of an ongoing effort to avoid paying for the use of another company's inventions.

Subsequently, an appeals court reexamined the ruling and determined that Apple had infringed two VirnetX patents, but the other two charges were reversed in November 2019 and the $ 502.6 million prize was vacant.
