During the press conference, Kleine played video clips of the Saturday night confrontation between Gardner and several other people that lead to Scurlock's death, the Omaha World-Herald reported.

Douglas County Attorney Donald Kleine, speaking during a press conference, said the actions of the bar owner, Jake Gardner, "were justified".

Gardner, a business owner, fatally shot Scurlock in an altercation that occurred during protests where buildings were damaged.

The Saturday night confrontation between Scurlock, Gardner, and a few other unidentified people happened amid protests in the city against police brutality in the wake of Floyd's death in Minneapolis. The skirmish continued, and Gardner remained on his back, with Scurlock getting Gardner in a chokehold. At that point, Gardner fires and hits Scurlock in his clavicle. Police said they arrested someone within the hour in connection with the shooting of protester James Scurlock.

Further protests have been planned in Omaha following Kleine's announcement. "I would hope that the they understand that we're doing our job to the best of our ability in looking at the evidence and the law and that's all we can do", Kleine said.

The Scurlock family is very disappointed by the decision, according to their attorney, Nebraska state senator Justin Wayne, who added that the family is requesting that Kleine turn the case over to a grand jury.

Prosecutors showed video of the incident before Kleine announced that he wouldn't file charges. "What we want is for this to go to court and get a full prosecution". In Omaha, 21 people were arrested on charges including disorderly conduct, failure to disperse, firearms possession and destruction of property.
