Ghislaine Maxwell Loses Late Bid to Block Deposition's Release, Quickly Appeals

Ghislaine Maxwell Loses Late Bid to Block Deposition's Release, Quickly Appeals”

Lawyers for Jeffrey Epstein's alleged accomplice Ghislaine Maxwell were denied a request to prevent her accusers from posting evidence online before her trial begins.

Maxwell, 58, pleaded not guilty on July 14 to helping Epstein recruit and eventually abuse three girls in the 1990s, and committing perjury by denying her involvement under oath.

If convicted, she could face up to 35 years in prison.

Preska's ruling late Wednesday came nearly a week after she ordered the documents unsealed - including portions of Maxwell's deposition and emails the socialite exchanged with Epstein.

"They set a perjury trap for Ms. Maxwell when (Giuffre) took her deposition". Prosecutors declined to comment on the allegation.

She has already once rejected Maxwell's argument against unsealing the papers on the grounds that it could release personal information.

It is now unclear whether the publication of the documents would go ahead as planned on Thursday.

Details of Ghislaine Maxwell's life are set to be revealed after a court decision.

The charges against Maxwell came almost a year after Epstein killed himself in a Manhattan jail where he awaited trial on sex trafficking charges. The late financier has previously been linked to a host of high-profile business leaders, scientists, royals and politicians. Her attorneys argue it was given under an expectation of confidentiality that had been agreed to by both sides in the dispute. That's according to a former butler of hers, Juan Alessi, who also said he had been given money to pay girls who massaged Maxwell and Epstein.

In April 2018, the Miami Herald intervened in the closed case, filing a motion to unseal the court records. She sued Maxwell for calling her account "obvious lies".

The depositions came from a now-closed civil defamation lawsuit against Maxwell by one of Epstein's accusers, Virginia Roberts Giuffre.

"Counsel shall file those documents on the public docket, under a heading of 'Documents Ordered Unsealed by Order of July 23, 2020, ' no later than July 30, 2020". The lawsuit was settled out of court.

They said defence lawyers said they believed they could reference victims by name publicly prior to trial because the individuals had gotten a "benefit" by publicly identifying themselves.

Parts of it were unsealed by a judge a year ago.

"In her first deposition, which is among the documents being considered on this motion, Ms. Maxwell refused to testify as to any consensual adult behavior and generally disclaimed any knowledge of underage activity", Preska said during the hearing, referring to testimony quoted in her federal indictment.

The testimony in the civil case - which was ordered sealed by a judge under a settlement agreement - should never have been given to prosecutors, Maxwell's lawyers argued.

Maxwell filed a notice of appeal less than an hour after Preska ruled.

If the circuit courtroom doesn't organize them to stay sealed, the paperwork shall be made public Monday, in accordance to Preska's order. "The public's right of access to Ms. Maxwell's deposition transcript is substantially outweighed by the compelling interest in ensuring her right to a fair trial".

Last night, Maxwell claimed her testimony in the deposition was handed over to the United States government.

Transcripts of the depositions were designated "confidential" and subject to a "Protective Order".
