The mother of the little boy, Bianca N. Digennaro, has filed a federal civil rights lawsuit over the incident.

After not complying, the teacher asked him to sit next to her.

'I'm here for my son, because I refuse to let them make him a convicted felon at the age of 8, just because he was having a mental breakdown'.

'Everybody knew this, ' Digennaro said, at the press conference on Tuesday.

TMZ reports that the authorities were called to Gerald Adams Elementary in Key West after the child in the video allegedly punched a teacher in the chest.

Police said the incident began when a teacher noticed the boy was sitting improperly at a lunch table. When he wouldn't listen to her, she went to get him to have him sit with her. I hate that you had to put me into this position to do this.

She then told the boy to walk with her and he told her: 'My mom is going to beat your a**'.

In his statement, Crump said the boy had an IEP, or Individualized Education Program for children with disabilities.

He said school officials and police should have handled the situation with these conditions in mind that day.

He is also heard telling the boy he's "going to jail".

According to School Resource Officer Michael Malgrat's arrest report, which the newspaper obtained, the teacher then told the boy to set next to her, and he refused, saying "Don't put your hands on me".

The footage shows one officer placing the sobbing boy against a filing cabinet inside the school office, frisking him and then trying to put metal handcuffs on him, which were too big to fit the child's wrists.

The video then shows the boy being escorted to a police vehicle. The bodycam video, posted online Sunday night by civil rights attorney Ben Crump, shows a Key West officer attempting to handcuff the boy at school.

A teacher is seen coming to the boy and comforting him before he's escorted out of the school.

"This is very serious, OK?" "The thing about it is, you made a mistake, and now it's time to learn from it and grow from it, right?"

Bodycam footage shows officers lecturing the boy while leading him out of the school and into their squad vehicle. The boy was taken to a juvenile justice facility in Key West, the Herald reported. Digennaro said it took eight months before prosecutors agreed to no longer prosecute. She added that she finds it hard to watch the video.

'I can tell and I can feel how scared my son was, ' she said.

Crump said the boy was mentally scarred by the incident.

The 8-year-old's family says he has ADHD and a defiance disorder, both of which the school knew about, and it should never have come to this.

Key West Police Chief Sean T. Brandenburg said based on the report, his officers followed standard procedures and did nothing wrong.

"Based on the facts of the case there is probable cause to believe that did violate FSS 784.081 (2c) by actually and intentionally striking Henriquez against her will", the incident report reads. The charge was dismissed October 7, 2019, Winter said.

The video has been seized on as yet another example of police brutality.

Former San Antonio Mayor Julian Castro shared the video on Monday, slamming the incident as "unbelievable".

'Police should have no role in punishing our kids or pulling traumatic stunts like this in our schools'.
