He said Barnes was accused of causing "damage to the reputation of the hotel", and of quarrelling with staff over not paying a corkage fee for alcohol brought to the hotel.

According to a widely shared Facebook post, Wesley Barnes, a 37-year-old man from Arkansas who works as an English teacher in Thailand, stayed at a resort on the island of Koh Chang in the Gulf of Thailand in June and found the service to be substandard.

In July 2020, Barnes left a review on TripAdvisor about his visit to The Sea View Resort in which he complained about "unfriendly staff" who did not smile and "act like they don't want anyone there".

In Thailand, if a company files a complaint against you (like they did here against Barnes) it can get you in serious trouble.

The AFP reported that he had not responded to a request for comment.

"We agree that using a defamation law may be viewed as excessive for this situation", the resort said in its statement.

"To have someone arrested at their workplace for posting a negative review is surely a step too far".

An American is facing up to two years in prison after an island resort in Thailand sued him over a negative Tripadvisor review. It has received 1,922 reviews, with 1,090 of them rating the resort excellent, 580 very good, 170 average, 48 poor and 32 awful. With no other available recourse, the resort filed charges under Thailand's strict defamation law. She was ultimately sentenced to the maximum of two years in prison.

One example that stands out in Thailand involves the Lop Buri poultry farm Thammakaset Co Ltd, a former supplier to the agribusiness giant Betagro.

Previously, a court had ordered the company to pay 1.7 million baht (US$53,700) in compensation to 14 migrant workers for forcing them to work up to 20 hours a day.

The retribution has been incessant.

In a case a year ago, a court in the province of Lopburi found a journalist, Suchanee Cloitre, guilty of defamation for posting a tweet in 2016 criticizing the labor practices of Thammakaset Co., the operator of a poultry farm.
