Trump's Supreme Court Nominee Grilled On Abortion rights, Obamacare

Trump's Supreme Court Nominee Grilled On Abortion rights, Obamacare”

They included abortion and a healthcare law known as Obamacare.

Ms Barrett was nominated to a lifetime post on the court on September 26 by Mr Trump to replace the late liberal Justice Ruth Bader Ginsburg. In fact, Barrett's conduct (e.g., attending the superspreader event, refusing to answer a question on whether she would recuse herself from the upcoming ACA case); her decision to not acknowledge that voter intimidation is illegal; and her freakish aversion to affirming that a peaceful transfer of power is essential to our democracy are not signs of neutrality.

Judge Amy Coney Barrett said she would put her religious beliefs aside when deciding cases. But - and, also, Roe v. Wade, not only is a precedent of 50 years, but there's a super precedent of 30 years that would kind of dictate that the court wouldn't overturn it. So Democrats are hoping to use the hearings to highlight the possible threat her appointment would mean to the Affordable Care Act, which Republicans are asking the Supreme Court - for the third time - to invalidate.

When pressed Tuesday during the second day of her Supreme Court confirmation hearing, Judge Amy Coney Barrett declined to comment on whether she believed the high court had wrongly decided two key cases guaranteeing a right to abortion, despite her past public comments and writings condemning them.

If Judge Barrett passes the committee hearing, the full Senate will vote to confirm or reject her for a lifelong place on the top U.S. court.

"I am not here on a mission to destroy the Affordable Care Act", Barrett said.

A Politico/Morning Consult survey shows 48 per cent of American voters want Barrett's confirmation to get through in contrast to a previous poll that showed only 37 per cent felt President Donald Trump should choose the next Supreme Court Justice.

"That's not a question I can answer in the abstract", she said.

"We knew that our faith would be caricatured; we knew our family would be attacked", she said.

Barrett declined to give her personal views and said she would just apply the law and adhere to the rule of law.

Democrats repeatedly cited cases of people with debilitating diseases and injuries who depended on the ACA and would be left without health care if the court rules the programme illegal.

There is no clearer example than the Affordable Care Act, which Republicans - unable to repeal or replace the law legislatively - have attacked with legal challenges in the courts for almost a decade.

And she rejected Harris's suggestion that she had to be aware that Trump openly said he sought a justice who would overrule the ACA. "I will approach it with no bias".

One way they could do that is drawing attention to Republicans' tradition of packing the courts that dates back to President Barack Obama's nomination of Myra Selby - a Black woman judge - to the 7th Circuit Court of Appeals in early 2016.

She acknowledged that laws require a justice or judge to recuse him or herself when there is an appearance of bias. Protesters are demanding lawmakers wait until after the election to appoint a new Supreme Court Justice while supporters argue the Senate shouldn't wait.

"If I were confirmed, and an election dispute arises, you know, both of which are ifs, I would very seriously undertake that process and I would consider every relevant factor", she said.

"I can't commit to you right now. but I do assure you of my integrity and I do assure you I would take the question very seriously".
