Kyle Rittenhouse, the IL teenager accused of killing two people during civil unrest this summer in Kenosha, Wis., will not face criminal charges in his home state, prosecutors said.

Rittenhouse faces first-degree intentional homicide, first-degree reckless homicide, attempted first-degree intentional homicide and other charges in the deaths of Joseph Rosenbaum and Anthony Huber and the wounding of Gaige Grosskreutz.

Accused Kenosha shooter Kyle Rittenhouse will not be charged in his home state of IL, prosecutors announced Tuesday.

But because there is no evidence that Rittenhouse ever "physically possessed" the rifle in the Prairie State he will not face additi onal charges there, Nerheim's office said, according to the report.

A Wisconsin man has reportedly admitted firing the first gunshot in the Kenosha riots, moments before Kyle Rittenhouse killed two people and wounded a third in what his attorneys are calling self-defense.

There is no evidence the gun was ever physically possessed by Rittenhouse in IL, the office said.

An attorney for Rittenhouse has previous said his client never had possession of the gun outside of Wisconsin.

"Kyle did not carry a gun across state lines", Wood said.

Joshua Ziminski, 35, faces disorderly conduct and use of a unsafe weapon charges stemming from the August 25 shooting during protests in the city over Jacob Blake's serious injuries after being shot in the back by police. "The gun belonged to his friend, a Wisconsin resident".

The Lake County statement did not provide any details about who may have possessed the gun or where it now is.

Rittenhouse's actions were apparently captured on graphic video posted on social media. He suggested, without evidence, that Rittenhouse may have been trying to protect himself when he fired his weapon. "He probably would have been killed".

Rittenhouse is due for an extradition hearing with the Lake County Court Oct. 30.

Rittenhouse of Antioch, remains held in a juvenile detention centre in Lake County without bond due to pending criminal charges in Kenosha.

After shooting Rosenbaum, Rittenhouse was seen in a now-viral video running on the street with a military-style rifle.
