Flynn was later charged with lying to the FBI about those conversations, and the Justice Department is now asking a federal judge to have that charge dismissed. Justice Department policies and tradition, too, call for prosecutors not to take public steps in cases close to an election that might affect the results.

In a statement announcing the investigation in May, Justice Department spokeswoman Kerri Kupec said: "Unmasking inherently isn't wrong, but certainly, the frequency, the motivation and the reasoning behind unmasking can be problematic".

Trump has in recent days complained about the Justice Department's lack of indictments against his Democratic rivals. The list included the names of more than three dozen former Obama administration officials.

Bash is one of several federal prosecutors in Trump's Justice Department to investigate Republican concerns on everything from the FBI's handling of investigations into Hillary Clinton to the prosecution of Flynn.

The probe was a spinoff of the one led by U.S. Attorney for Connecticut John Durham, who is investigating the origins of the Russian Federation investigation - which involved the Obama administration surveilling members of the Trump campaign in 2016. A third meta-investigation conducted by U.S. Attorney John Durham is apparently ongoing, but Barr has told GOP senators that no findings will be released before the election, angering Trump.
