Scott Peterson's conviction for murdering his pregnant wife Laci and their unborn son will now be re-examined less than two months after the California Supreme Court overturned his death penalty.

In August, Peterson's defense won an appeal in which they managed to overturn the death sentence.

Peterson has been sentenced to death in 2005 after being convicted of first-degree murder with special conditions, along with second-degree murder to the couple's unborn child. Scott Peterson had been having an affair with Amber Frey, a massage therapist from Fresno.

The California Supreme Court's actions, he said, "reflect the importance of jury selection in a case". If a judge finds the juror indeed committed prejudicial misconduct, Peterson could be granted a new trial.

Geragos said the case had a recurring problem with "stealth jurors".

Nice filed a lawsuit to obtain a restraining order against the woman, saying she feared for her unborn child.

"Now we're going to have a hearing and see if that impacted the conviction, which I'm sure it did", he said.

The state Supreme Court's ruling comes in response to Peterson's 2015 petition for habeas corpus.

"Jurors may not be excused merely for opposition to the death penalty, but only for views rendering them unable to fairly consider imposing that penalty in accordance with their oath", Justice Leondra R. Kruger wrote for a unanimous California Supreme Court.

The juror was initially an alternate for the trial, but replaced another member who was discharged during deliberations. She later co-wrote a book about the case with several other jurors. This included the fact that he had been close to the area the bodies were found on the day of Laci's disappearance; had visited the crime scene repeatedly; was in possession of tarps covered in gasoline and fertilizer both of which allegedly destroy DNA and his testimony regarding the cooking show Laci was watching as he left and the rain which stopped him from continuing fishing do not align with the date.

Peterson's attorneys argued Nice worked hard to get on the jury.

But Peterson's appellate team says Nice lied on a juror questionnaire, omitting that she previously filed for a restraining order against her then-boyfriend's ex-girlfriend for alleged harassment.

Convicted murderer Scott Peterson's hopes to get out of prison were given a boost.
