Federal Bureau of Investigation arrests son of Brooklyn judge on Capitol riot charges”

The son of a NY judge was arrested Tuesday for participating in last week's violent rampage at the US Capitol building by supporters of President Donald Trump, prosecutors said.

He was to make a remote court appearance later in the day to face charges, including theft of government property. Aaron was released to the custody of his older brother, and was ordered to stay in NYC (unless given permission) and wear an ankle monitor. He is due to appear before a judge in Brooklyn later Tuesday.

Prosecutors allege that he stole a police riot shield and bulletproof police vest during the rampage.

The complaint cited the Post interview, which appeared to have been conducted inside the Capitol building. Mostofsky told the Post he went to D.C. on January 6 to protest a "stolen election".

The photos, along with coverage by the New York Post, helped Federal Bureau of Investigation agents identify Mostofsky, who is the son of Shlomo Mostofsky, a Kings County Supreme Court judge and prominent figure in the Orthodox Jewish community. Video of the arrest shows them entering his home and removing the fur pelts and walking stick he was photographed with inside the Capitol building.

Mostofsky faces up to ten years in prison if convicted of the most serious charge.

Fire department spokesperson Bianca Gillett said Tuesday that the agency was made aware of the arrest and that an update on his status with the fire department was expected later.

"While we all respect each other's ability to peacefully exercise their First Amendment rights, acts in violation of federal law will not be tolerated", William F. Sweeney, Jr., assistant director in charge of the FBI's NY field office, said in a statement.
