Trump's Second Impeachment Trial to Commence Week of February 8, Schumer Says”

Senate Majority Leader Chuck Schumer said the sole article of impeachment against former President Donald Trump will be delivered to the Senate on Monday, a move that would trigger preparations for a Senate trial against Trump.

The timeline was a compromise after Republican Senate leader Mitch McConnell had asked the Democratic-led House to delay sending the charges until next Thursday, and called on Schumer to postpone the trial until mid-February to give Trump more time to prepare a defense.

Last week, the House voted to impeach Trump over his role in provoking the U.S. Capitol riot on January 6.

Democrats and Republicans are still negotiating on the details of an impeachment resolution that would set out the rules for a Senate trial - including on how long it would last, what votes or motions would be in order, and other factors. Senators will be sworn-in as jurors the next day. The first time the House impeached Trump, on December 18, 2019, Pelosi held off for nearly a month before sending the articles to the Senate for trial.

"Once the briefs are drafted, presentation by the parties will commence the week of February 8", Schumer told colleagues on the Senate floor.

"Healing and unity will only come if there is truth and accountability, and that is what this trial will provide".

Members will deliberate whether to convict Trump on what the US Constitution describes as "high crimes and misdemeanors".

Mr Trump was impeached on a single charge of "incitement of insurrection" for his role in whipping up his supporters during a speech in Washington on 6 January, the day a pro-Trump mob stormed Congress and threatened the lives of politicians and then-vice president Mike Pence.

The House last week paved the way for the Senate proceedings by charging Mr Trump with inciting the violence, which left five people dead.

The Constitution calls for the chief justice of the U.S.to preside over a presidential impeachment trial, as John Roberts did for Trump's trial a year ago.

Republicans have attempted to delay the proceedings to allow for Trump to have more time to prepare his defence.

"As I understand, it must be headed our way Monday".

The timing on when the House would transmit the impeachment article had been left in the air as the Senate changed from Republican to Democratic control and worked to quickly confirm several of Biden's Cabinet nominees.

But the Senate can agree to its own parameters of the trial timeline. He said Senate Republicans "strongly believe we need a full and fair process where the former president can mount a defense and the Senate can properly consider the factual, legal and constitutional questions".

White House spokeswoman Jen Psaki told reporters that the Senate should be able to move forward with both the trial and Biden's agenda, beginning with his call for $1.9 trillion of fresh COVID-19 assistance for Americans and the USA economy.

With the Senate now comprised of 50 Democrats and 50 Republicans, and a two-thirds majority needed to convict Trump, at least 17 Republicans would have to vote against the former president to secure a conviction. "There will be a vote, up or down, on whether to convict the president".

Republican Sen. Lindsey Graham of SC helped Trump find Bowers after members of his past legal teams indicated they did not plan to join the new effort.
