Supreme Court Agrees To Consider Reinstating Death Sentence For Boston Marathon Bomber”

The Supreme Court on Monday agreed to review a lower court opinion that wiped away the death sentence of Dzhokhar Tsarnaev, one of the brothers convicted in the 2013 Boston Marathon bombing that killed three spectators and injured hundreds.

But Biden has pledged to seek an end to the federal death penalty.

In just over two months in office, the new administration has reversed its predecessor's position in several high court cases.

In October, while Mr Trump was still president, the Justice Department requested the Supreme Court review the case.

White House Press Secretary Jen Psaki said Biden continues to have "grave concerns" about capital punishment but has also expressed "horror" about Tsarnaev's actions and the bombing.

Tsarnaev and his elder brother Tamerlan, both Kyrgyz-American nationals of Chechen descent, planted bombs close to the finish line of the Boston Marathon on 15 April 2013. Tsarnaev's brother died after a gunfight with police.

Nancy Gertner, a retired federal judge who teaches at Harvard Law School, said that "the government should consider whether continuing to pursue a death sentence for him is unnecessarily traumatizing for the victims' families and the city of Boston".

Judge O. Rogeriee Thompson of the U.S. Court of Appeals for the First Circuit wrote "core promise of our criminal-justice system is that even the very worst among us deserves to be fairly tried and lawfully punished", adding that "a judge handling a case involving prejudicial pretrial publicity must elicit "the kind and degree" of each prospective juror's 'exposure to the case or the parties, ' if asked by counsel".

The appeals court also ruled the judge unfairly excluded evidence implicating Tamerlan - who the defense had described as the mastermind behind the attack.

Police captured a bloodied and wounded Dzhokhar Tsarnaev hours later in the Boston suburb of Watertown, where he was hiding in a boat parked in a backyard.

The Justice Department last year-under former President Donald Trump-challenged a federal appeals court order that vacated Tsarnaev's capital sentence.

Tsarnaev, now 27, was convicted of all 30 charges against him, including conspiracy and use of a weapon of mass destruction and the killing of a Massachusetts Institute of Technology police officer during the Tsarnaev brothers' getaway attempt.
