Biden forms commission to investigate several Supreme Court policies, including adding justices

Biden forms commission to investigate several Supreme Court policies, including adding justices”

After it was announced on Friday that the Biden administration has launched a commission to explore increasing the size of the Supreme Court, Fox News' Peter Doocy asked the White House why Biden could be into the idea now, even though he spoke against it some years ago.

Biden has been under pressure to add seats to the bench to compensate for a right-ward political shift after former President Donald Trump appointed three nominees.

Senate Minority Leader Mitch McConnell (R-Ky.) said the White House is directly assaulting the nation's independent judiciary.

The commission will have 36 members, some of them prominent names. As a source close to the White House tells the New York Times, the commission "is meant to provide a forum to debate the issue that is protected from the passions that will continue to rage in the political arena".

The 36-member commission will be co-chaired by former White House Counsel under President Barack Obama, Bob Bauer, who now serves as the Professor of Practice and Distinguished Scholar in Residence at New York University School of Law, and Yale Law School Professor Cristina Rodriguez, who previously served as deputy assistant attorney general in the DOJ's Office of Legal Counsel, also under Obama.

The panel will be led by Bob Bauer, who served as White House counsel for former President Barack Obama, and Cristina Rodriguez, a Yale Law School professor who served in the Office of Legal Counsel for Obama.

".The makeup of this commission which was vital for the President, there are progressives on the court, there are conservatives on the court. But we don't have time to spend six months studying the issue - especially without a promise of real conclusions at the end", said Aaron Belkin, director of Take Back the Court, a group pushing for more justices on the bench.

Left-leaning Justice Stephen Breyer expressed caution over a politically motivated increase in the number of justices on the Supreme Court this week because he said it would undermine the judicial branch's "legal principle".

White House Press Secretary Jen Psaki said the commission will represent the full political spectrum.

Before the death of Justice Ruth Bader Ginsburg, Roberts and liberal justices formed a majority that generally left the issue up to elected officials, saying judges don't have the expertise or power to overrule decisions made with the public's health in mind. The aim of his address - named in honor of his late conservative colleague Justice Antonin Scalia - was to "make those whose initial instincts may favor important structural change or other similar institutional change, such as forms of 'court-packing, ' think long and hard before they embody those changes in law."... "And it is doubly wrong to think of its members as junior league politicians".

McConnell said it's another sign of the far-left's influence over the Biden administration.

"California treats some comparable secular activities more favorably than at-home religious exercise", allowing hair salons, retail stores, and movie theaters, among other places, "to bring together more than three households at a time", the unsigned order from the court said.

It feels odd for me to have to remind a sitting justice that nowhere in the Constitution does it say there should be nine justices on the court.

Legal observers called the list "super impressive" but unlikely to endorse "radical change". "There are no easy or quick solutions to the politicization of judicial confirmations and the toxic cloud that has descended over many constitutional debates".
