Democrats Plan To Expand Supreme Court Has Bleak Future”

The legislation would transform the high court's panel from the nine to the 13.

While advocates have been pushing for addition of seats to the Supreme Court, not much has moved as the count remains at nine since 1869.

Nadler argued that given the fact that there are now 13 federal appeals courts, it is logical to have 13 justices to oversee the corresponding circuits, as was the previous tradition. That is unlikely as moderate Democrats like Sens. Hank Johnson (D-GA) and Mondaire Jones (D-NY).

Sen. Edward J. Markey (D-Mass.) echoed that argument, saying, "The Republicans stole two seats on the Supreme Court and now it is up to us to fix that damage".

Progressive groups remain enraged at what they see as Republican manipulation of the Supreme Court nomination process in order to give President Trump two appointments to the court: First, by blocking President Obama's nominee to the Supreme Court for almost a year, and then by rushing through Amy Coney Barrett's nomination just over a month after Ruth Bader Ginsburg's death.

The discussion around the expansion of court has taken a new urgency as the 6-3 conservative majority of justices is poised to consider key questions surrounding voting rights, abortion rights, civil rights, gun control and access to healthcare in the coming years. Senate Republicans have politicized the Supreme Court, undermined its legitimacy, and threatened the rights of millions of Americans, especially people of color, women, and our immigrant communities. "Progressives understand we can not afford to wait six months for an academic study to tell us what we already know: the Supreme Court is broken and in need of reform", Demand Justice Executive Director Brian Fallon said in a statement. "Too many Americans view our highest court in the land as a partisan, political institution, not our impartial, judicial branch of government". "Republicans stole two seats on the Supreme Court, and now it is up to us to fix that damage".

President Joe Biden last Friday ordered a study of adding seats to the Supreme Court, creating a bipartisan commission that will spend the next six months examining the politically incendiary issues of expanding the court and instituting term limits for its justices. Biden proposed the measure as a way to mitigate accusations of politically-motivated "court packing" by including both parties in the process.

Titled the Judiciary Act of 2021, the bill barely runs two pages and amends the definition of a quorum from the chief justice and eight associate justices to the chief and 12 associates.
