George Floyd killer Derek Chauvin asks for new trial”

One of the jurors who served on the trial of former Minneapolis police officer Derek Chauvin reportedly sported a Black Lives Matter T-shirt with a reference to the death of George Floyd.

Mitchell asserted that the event was not a rally for Floyd's death or against police brutality.

Chauvin lawyer Eric Nelson asserts in the filing that Judge Peter Cahill "abused" his discretion in numerous ways, such as denying Chauvin a change of venue, denying an earlier request for a new trial "on the grounds that 'publicity during the proceedings threaten [ed] the fairness of the trial, '" and for failing to sequester the jury in the high-profile case.

Mr. Nelson gave few details on alleged prosecutorial misconduct, which he said included "disparaging the Defense; improper vouching; and failing to adequately prepare its witnesses".

Mitchell, 31, attended a demonstration in the American capital on August 28, commemorating the 57th anniversary of the March on Washington, where Dr Martin Luther King jnr made his famous "I Have a Dream" speech.

Mitchell said he had not and could serve impartially.

Ultimately, it will be Cahill's decision.

Floyd's death led to protests in the United States and overseas about excessive use of force by police against people of color. "My answer was no because I hadn't", he told WCCO-TV in Minneapolis. All 12 jurors were asked during selection if they had attended any such events as part of a 14-page questionnaire, as well as for their opinions on the Black Lives Matter movement.

"You're not going to confession", he said of the duty of prospective jurors during voir dire.

Speaking to the Star Tribute, Mitchell insisted he had been honest throughout the process, and said the march was "100 per cent not" for Floyd specifically. "The date of the March on Washington is the date", he told the newspaper.

Mitchell told the newspaper his uncle had posted the photo to social media.

Judge Cahill will now have to determine whether Mitchell "lied about, or failed to provide complete answers on whether he has engaged in activism, or whether he has any affiliations with Black Lives Matter that go beyond the mere wearing of the shirt", Dunn added.

Nelson said Cahill also violated Chauvin's right to a fair trial when he declined to force Morries Lester Hall, a passenger in Floyd's auto the night he was killed, to testify or to allow the defense to enter into evidence statements that Hall made to law enforcement after Floyd's death.

Chauvin, who is being held in solitary confinement at a Minnesota prison while awaiting his June 25 sentencing, faces as much as 40 years under enhanced sentencing guidelines requested by the state. Mitchell helped convince those who weren't sure that they should convict Chauvin on all three counts.
