SCOTUS Favors Profane Pennsylvania Cheerleader In Free-Speech Case”

The long battle over whether armed teachers must have extensive police-level training is over, as the Ohio Supreme Court ruled today that staffers must have hundreds of hours of training before they carry guns in school, according to the Journal-News. The court ruled that while schools do maintain some interest in regulating students' off-campus speech, the factors in the case of the cheerleader, Brandi Levy, weighed against the school's actions.

Justice Clarence Thomas issueed a dissent arguing that the majority did not look closely enough at the precedents about how schools may punish students for speech that happens outside of school but could affect what happens inside of the schoolhouse gates. "The school's regulatory interests remain significant in some off-campus circumstances". Federal district and appeals courts found the move violated Levy's free speech rights, but offered contrasting reasons for the decisions. President Joe Biden's administration supported the district in the case, arguing that off-campus student speech deserves broad protection unless it threatens the school community or targets specific individuals, groups or school functions. Levy, now an 18-year-old college student studying accounting, had been a member of the high school's junior varsity cheerleading squad and tried out near the end of her freshman year for the varsity team. So she posted a photo of herself and a friend flipping the bird to the camera, along with a message that said, "F*** the school, ". "We do not believe that thespecial characteristics that give schools additional license to regulate student speech always disappear when a school regulates speech that takes place off campus".

"F-k school f-k softball f-k cheer f-k everything" Brandi Levy, then 14, wrote on Snapchat in 2017. "Because the board's April 2018 resolution purports to authorize certain school employees to go armed while on duty without also requiring that those employees satisfy the training-or-experience requirement (violates state law)".

Wednesday's ruling basically adopted the reasoning of Judge Thomas Ambro of the 3rd U.S. Circuit of Appeals in Philadelphia. An attorney for Levy argued such harassing speech is already prohibited. "But sometimes it is necessary to protect the superfluous in order to preserve the necessary", Breyer wrote in closing his opinion.

Justice Samuel Alito wrote in a concurring opinion that school officials in Mahanoy got "carried away" in seeking to discipline Levy.

Ruled that the structure of the government agency that oversees mortgage giants Fannie Mae and Freddie Mac is unconstitutional, sending that case back for further review.
